1.1. Seller – a legal person, specified in teh order of goods, whose goods are sold on the baginbox.store website in accordance with these Rules and who is responsible for the execution of the order submitted by the Buyer. The contact information of the seller with whom the purchase-sale agreement of the relevant goods is concluded in accordance with these Rules are specified in the Goods order.
1.2. Baginbox.store – is a website located at www.baginbox.store , which contains the Seller’s goods for sale and which is administered by the Republic of Lithuania VĮ “Registrų centras”, a private legal entity UAB “LIPIS” , legal entity code 303047531, VAT payer code LT100007710619, registration and correspondence address Rąžės g. 27, Peskojų k., LT-92385 Klaipėdos r.
1.3. Buyer – 1) able individual person, i.e. a person of age, whose abilities are not limited by court order; 2) legal entity.
1.4. Parties – the Buyer and Seller together.
1.5. Personal data – any information about an identified or identifiable natural person (data subject); an identifiable natural person is a person whose identity can be determined directly or indirectly, in particular by an identifier such as a name, a personal identification number, location data and an Internet identifier, or by one or more of that natural person’s physical, signs of physiological, genetic, mental, economic, cultural or social identity.
1.6. Rules – the rules are the following Purchase, Refund & Returns Policy, which are applied to each purchase of the Buyer on Baginbox.store and to each Purchase and Sale Agreement concluded between the Buyer and the Seller.
1.7. Account – the result of the Buyer’s registration at Baginbox.store based on the Rules for using https://baginbox.store/ , which creates a personal Buyer’s account that protects his personal data and order history.
1.9. Store – electronic store located at https://baginbox.store/ .
1.10. Agreement – the purchase and sale agreement of the respective Goods concluded between the Buyer and the Seller, which is considered to be concluded from the moment the Order is submitted. It is considered that the terms of each Agreement concluded by the Buyer and the Seller are identical to the terms of the Rules valid at the time of placing the order and such Agreements are always executed by the parties in accordance with the Rules valid at the time of placing the order.
1.11. Order – Order of Goods, which contains the Goods that the Buyer wishes to purchase from the Seller, specified in the same order.
2. General provisions
2.2. When creating an account on Baginbox.store, the Buyer confirms the Rules during the first registration. After the Buyer approves the Rules during the first registration (account creation), the Rules apply to all the Buyer’s purchases made on Baginbox.store and to all Agreements concluded with Sellers until the updated Rules are published on www.baginbox.store. After updating the Rules, they apply from the moment of their publication on www.baginbox.store.
2.4. In the event of a change in market conditions or in the presence of circumstances provided for in the legislation of the Republic of Lithuania, Baginbox.store has the right to change, amend or supplement the Rules. The Buyers will be informed about this when logging in to the Account or baginbox.store or when creating a shopping cart, but in any case, after the Rules are updated, the Buyer can place an order only if he familiarizes himself with and approves the new version of the Rules.
2.6. If the Seller has the right or obligation to provide the Buyer with information or documents by e-mail, in all cases, the Buyer is responsible for providing the Seller with a working e-mail address belonging to the Buyer.
Ordering of the goods, rights & obligations
3.1. The Buyer can order goods on Baginbox.store by choosing one of the following methods:
3.1.1. by registering online at Baginbox.store (by entering registration name and password);
3.1.2. online without registering at Baginbox.store;
3.1.3. by phone;
3.1.4. by writng and email to email@example.com .
3.4. When the Buyer, who chose the goods to be purchased and created a basket of goods, completes all the steps of the order, the last of which is the selection and confirmation of the payment method, it is considered that a purchase-sale legal relationship has arisen between the Seller and the Buyer and a purchase-sale contract has been concluded. The Buyer is informed about the confirmation of the order by sending a message to the e-mail specified by the Buyer. The Seller sends the Buyer a link to the valid Rules together with the order confirmation to the e-mail address specified by the Buyer.
3.5. All essential information about the product and its features is provided in the product description on Baginbox.store .
4. Buyer’s Rights
4.1. The Buyer has the right to buy goods and order services on Baginbox.store in accordance with the procedure established by these Rules.
4.2. The Buyer has the right to refuse the order in accordance with the procedure established by these Rules.
4.3. The Buyer has the right to withdraw from the Agreement in accordance with the procedure established by these Rules.
4.4. The Buyer has the right to exchange or return the purchased goods in accordance with the rules.
5. Obligations of the Buyer
5.2. The buyer must pay for the ordered goods or services and accept them in accordance with the procedure established by these Rules.
6. Seller’s rights
6.1. The Seller has the right to cancel the Buyer’s order without prior warning, if the Buyer, having chosen the payment methods provided for in points 8.2.1 or 8.2.2 of the Rules, does not pay for the goods within 5 (five) working days.
7. Obligations of the Seller
7.1. The Seller undertakes to carry out the Buyer’s orders in accordance with the procedure set out in these Rules and to communicate with the Buyer by means of the Baginbox.store website (when the order was submitted in the manner provided for in point 3.1.1) or through the Buyer’s contact data specified by the Buyer (when the order was submitted in one of the methods in clauses 3.1.2-3.1.4.
7.3. Baginbox.store undertakes to inform the Buyer before placing the order about the suspension or termination of Baginbox.store functions relevant to the fulfillment of the order. Providing information in the Baginbox.store Account or the Baginbox.store e-commerce website is considered appropriate information. When the Buyer’s order has already been accepted for execution, the Buyer is informed about the suspension or termination of Baginbox.store functions relevant to the fulfillment of this order by one of the contact details specified by the Buyer (by phone, SMS message or e-mail).
7.4. Under the conditions stipulated in the rules, the Seller undertakes to provide the goods ordered by the Buyer and to accept the goods returned by the Buyer.
7.5. In exceptional cases, in the event of objectively justified circumstances, which the Seller could not foresee and control in advance, the delivery of the goods may be delayed or become impossible. In this case, the Seller undertakes to immediately contact the Buyer regarding the possibilities of further execution of his order. The Seller can offer the Buyer a similar product through one of the contact details specified by the Buyer (by phone, SMS message or e-mail). If the Buyer does not consent to the replacement of a specific Seller’s product by a similar product, the Seller, who is unable to deliver the product chosen by the Buyer, undertakes to immediately return the money paid to the Buyer no later than within 5 days, if prepayment was made, and in all cases to cancel order.
7.6. The Seller, not agreeing to the Buyer’s requirements, must provide the Buyer with a detailed, motivated written answer no later than within 14 (fourteen) calendar days from the date of receipt of the Buyer’s application, unless the legal acts of the Republic of Lithuania and the European Union stipulate otherwise.
7.7. The Seller undertakes to fulfill other obligations imposed on the Seller in the Rules and legal acts of the Republic of Lithuania.
8. Product pricing, payment procedure and terms
8.1. Product prices on Baginbox.store are indicated in euros, excluding the amount of VAT applicable at the time according to the legislation and other taxes, if applicable.
8.2. The Buyer can pay for the ordered goods in one of the following ways (the choice may be limited, so the final list of payment methods applicable to the relevant order is indicated with the relevant order):
8.2.1. using electronic banking;
8.2.2. Bank transfer;
8.2.3. by bank card;
8.2.4. in other ways indicated on the Baginbox.store website
8.3. When the Seller receives payment for the goods, the order for goods is confirmed.
8.4. By approving the Rules, the Seller sends documents for the purchase of goods – VAT invoices, which are also the warranty documents applicable to the goods – electronically to the e-mail address specified in the Buyer’s registration form immediately after the order is fulfilled. VAT invoices indicate the details of the Seller, the selected goods, their quantity, the discounts granted, the final price of the goods, including all taxes, and other data required to be approved by legal acts regulating accounting.
8.5. VAT invoices for goods purchased by the Buyer can also be seen on the Buyer’s Baginbox.store Account. After the Buyer submits the order, he will be able to see and print the order sheet – the prepayment invoice.
8.6. After the Seller has confirmed the order, the price of the goods may change only in exceptional cases due to objective and essential reasons beyond the control of the Seller (in the presence of evidence supporting these reasons). If the reasons for the price change are justified and in such a case the Buyer does not agree to purchase the product at the new price, the Buyer may cancel the order by informing the Seller about this via Pigu.lt within 2 (two) working days through the contacts indicated on the Baginbox.store e-commerce website. The Seller undertakes to return to the Buyer all amounts paid by him in accordance with such canceled order. Reasons for price changes are assessed on a case-by-case basis.
Shipping, warranty & contract
9. Shipping & delivery
9.1. When ordering goods, the Buyer must indicate specific and correct details for shipping address:
9.2.1. The buyer undertakes to indicate the exact place of delivery of the goods.
9.2.2. The buyer undertakes to accept the goods himself. When accepting goods, it is necessary to present a valid personal identification document (identity card, passport or new model driver’s license). If the Buyer does not accept the goods himself, even though the goods are delivered to the address specified by the Buyer, the Seller has the right to transfer the goods to another person at the address specified by the Buyer, and the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong person.
9.3. Goods are shipped exclusively to European countries. Buyers are responsible for awareness and adherence to this regional limitation: Finland, Sweden, Norway, Denmark, Estonia, Latvia, Lithuania, Poland, Moldova, Romania, Bulgaria, Greece, North Macedonia, Albania, Serbia, Montenegro, Bosnia Herzegovina, Hungary, Croatia, Slovenia, Slovakia, Austria, Czech Republic, Germany, Switzerland, Italy, Monaco, France, Belgium, Luxembourg, Netehrlands, Spain, Portugal, United Kingdom, Ireland, Andorra, Vatican City, San Marino.
9.4. In exceptional cases, the delivery of the goods may be delayed due to unforeseen circumstances beyond the control of the Seller, which the Seller could not control and reasonably foresee at the time of the conclusion of the sales contract. In this case, the Seller undertakes to immediately contact the Buyer and coordinate the delivery terms and other conditions.
9.5. The Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of third parties unrelated and/or independent of the Seller or due to circumstances beyond the control of the Buyer.
9.6. During the delivery of the goods to the Buyer, the Buyer must check the condition of the shipment and the product(s) together with the courier and sign the shipment transfer – acceptance document. If the Buyer accepts the order from the courier, it is considered that the goods have been handed over in a suitable condition, without damages, the basis of which cannot be attributed to a factory defect, and there are no inconsistencies in the product(s) assembly (such as can be determined during the external inspection of the goods). Having noticed that the packaging of the delivered product is damaged (crumpled, wet or otherwise externally damaged), the product(s) is damaged and/or the product(s) is not complete, the Buyer must note this in the product transfer – acceptance document and, in the presence of the courier, Baginbox.store or its representative, to draw up a free-form act of violation/non-compliance of the shipment and/or product(s). If the Buyer does not perform these actions, the Seller is released from responsibility for damage to the goods, when the basis for the occurrence of such damage is not a factory defect, and for discrepancies in the product package only if these discrepancies can be determined during an external inspection of the goods.
9.7. The risk of accidental loss or damage of the goods passes to the Buyer from the moment the goods are handed over to the Buyer.
10. Product quality guarantee and expiration date
10.1. The goods offered by the seller are of suitable quality. The product complies with the consumer purchase and sale contract if:
10.1.1. the product corresponds to the description provided by the Seller and has the same characteristics as the product that the Seller provided as an example or model when promoting that product on Baginbox.store;
10.1.2. the product is suitable for the purpose for which products of this type are normally used;
10.2. The Seller provides a 1 year quality warranty valid for unused products. The warranty invoice for the goods serves as a warranty document.
11. The procedure for exchanging and returning goods
11.1. If the Buyer receives a product with defects or inadequate quality, the Seller offers him return & refund or a possibility to change the defected products with a new order.
11.2. If the wrong goods were delivered to the Buyer, the Buyer must immediately, but no later than within 7 (seven) working days, inform Baginbox.store by e-mail or by calling the phone number +370 633 64 143. In such case, the Seller picks up such goods and replaces them with suitable goods. In the event that the Seller does not have the ordered goods, he returns the money paid for the item(s) to the Buyer and picks up the wrong order. Money is returned to the Buyer immediately but no later than within 7 days after the Seller received the Buyer’s notification that the wrong goods were received.
11.3. If the Buyer wants to return the order which meets all the quality requirements, he must firstly write to firstname.lastname@example.org and await for further instrctions. n such case, if the order included additional gifts, they also must be returned unused and unopened.
12.1. The Buyer is responsible for illegal actions performed using Baginbox.store .
12.2. After registering, the Buyer is responsible for storing and/or transferring his login data to third parties. If the services provided by Baginbox.store are used by a third person who has connected to Baginbox.store using the Buyer’s login data, the Seller considers this person to be the Buyer.
13.1. Our refund and returns policy lasts 30 days. If 30 days have passed since your purchase, we can’t offer you a full refund or exchange.
13.2. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
13.3. To complete your return, please write us an email to email@example.com with a cause of return and a receipt or proof of purchase. Then we will provide you with further instructions to complete a return. Please do not send your purchase back without informing us first.
13.4. Please keep in mind that if the returned order is in not its orignal condition, is damaged ir missing parts for reasons not due to our error, we will not be able to provide you with a refund.
14.1. Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
14.2. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
15. Late or missing refunds
15.1. If you haven’t received a refund yet, first check your bank account again.
15.2. Then contact your credit card company, it may take some time before your refund is officially posted.
15.3. Next contact your bank. There is often some processing time before a refund is posted.
15.4. If you’ve done all of this and you still have not received your refund yet, please contact us at firstname.lastname@example.org .
16. Sale items
16.1. Sale items may be refunded. In such case, refund is made in sale price.
17.1. We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at email@example.com and we will provide you with details of further steps.
18.1. If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.
18.2. If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and they will find out about your return.
19.1. To return your product, you should first send us an email to firstname.lastname@example.org and then receive durther instructions for returning the order.
19.2. You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
19.3. Depending on where you live, the time it may take for your exchanged product to reach you may vary.
19.4. When returning the items, you must use a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item if the order is shipped without any tracing information.
